11/05/2026 Bayside Editorial: Updating manual protects everyone

Updating manual protects everyone

The Berlin Town Council’s modernization of some aspects of the town’s employee manual addresses the realities of the modern workplace as well as the labyrinth of federal wage and hour rules.

First, town officials recognized the futility of trying to forbid romantic relationships between coworkers. Strict blanket bans rarely work, as enterprising couples can simply resort to secrecy, disingenuous behavior, or outright lying.

Berlin’s updated policy takes a pragmatic approach by acknowledging that workplace romances happen while requiring employees to disclose them to supervisors.

This shift gives the town legal protection should a relationship end poorly. While a couple could still attempt to conceal their status, non-disclosure—rather than the romance itself—becomes the fireable offense.

The policy also maintains a necessary red line: supervisors are barred from romantic relationships with direct subordinates, shielding the town from conflicts of interest, coercion, and claims of favoritism.

Beyond interpersonal policy, the council also addressed legal exposure on the operational side by clarifying how hours worked, flex time, and make-up hours are tracked.

Public agency wage and hour procedures are governed by the federal Fair Labor Standards Act (FLSA), enforced by the U.S. Department of Labor’s Wage and Hour Division.

The Wage and Hour Division has no tolerance for non-compliance, and improper record keeping can lead to back-pay audits and penalties.

By clarifying the rules of scheduling, flex time, breaks and record-keeping, the town is establishing the path it needs to follow to protect both its employees and its taxpayers.
